Scope

These terms apply to every Premium subscription, whether taken by a consumer or by a business. They are accepted when the order is confirmed and prevail over any other document. The applicable version is the one in force on the order date.

Essential characteristics of the offer

Premium gives access, for the term subscribed, to the features presented in the app as reserved to that plan. It is a digital service delivered online, with no physical medium, accessible from a recent browser and an internet connection.

The exact scope, term and price are those displayed on the order page before payment is confirmed. The free plan remains available without any subscription.

Prices and taxes

Prices are shown on the order page, in the currency displayed there. The total amount payable is shown before the order is finally confirmed.

The operator does not currently collect US sales, use or similar transaction tax. This reflects the absence of a US registration or physical presence, not a conclusion that no state has established economic nexus over these sales; the position should be reassessed as US revenue grows, against each state’s economic-nexus thresholds for remote sellers of digital services. Order and payment

An order follows these steps: selecting the plan in the app, redirection to the secure payment page operated by Stripe, entering card details, review and payment confirmation. Confirmed payment forms the contract.

Payment is handled by Stripe. Card details are collected and stored by Stripe under its own terms; they do not pass through Runaway’s servers and are never stored there. A confirmation is sent to the email address associated with the account.

If payment is declined or fails, access to Premium features may be suspended after an email notice, without affecting access to the free plan or your saved plans.

Term, renewal and cancellation

The subscription runs for the period displayed at checkout and renews automatically for identical periods until cancelled. You can cancel at any time from the billing portal available in your account; cancellation takes effect at the end of the current period.

Several states, including California, Vermont and Illinois, impose specific disclosure and reminder requirements for automatically renewing consumer subscriptions. The recurring nature of the subscription is disclosed at checkout and a self-service cancellation path is available in the billing portal at all times; state-specific notice-timing requirements have not been individually verified for every state. Cancellation and refunds

US law does not provide a general cooling-off right for digital subscriptions delivered immediately. Premium is a digital service, not a good, so the implied-warranty provisions of the Uniform Commercial Code as adopted by the various states generally do not apply to it. State consumer-protection statutes prohibiting unfair or deceptive trade practices may still apply. Disputes

These terms are governed by the laws of France; the French consumer mediator and the EU online dispute resolution platform described above are not available to US residents. No arbitration clause or alternative dispute-resolution scheme is currently designated for US customers; disputes are resolved before the courts having jurisdiction over the operator’s registered address, without prejudice to any consumer-protection right that cannot be displaced by this choice of law.
